<p>TAYLORSVILLE — A 34-year-old man has been arrested for investigation of multiple counts of sex abuse against a 13-year-old girl.</p>
<p>The four-month relationship was discovered after a bizarre incident at the man&#8217;s house in which one of his housemates was shot by a third housemate who was reportedly trying to shoot a mouse in his kitchen with a 9mm handgun, according to investigators.</p>
<p>Paul Daniel Kunzler was booked into the Salt Lake County Jail for investigation of two counts of rape of a child, three counts of sodomy of a child and three counts of sexual abuse of a child.</p>
<p>The string of events began to unfold about 2 a.m. Tuesday when police were called to a house, 2584 W. Brucemont Dr. (5450 South), on a report of an accidental shooting. Officers arrived to discover that a man who was in the bathroom had accidentally been shot in the chest by his 27-year-old housemate who was shooting at a mouse in the kitchen with a handgun, said Taylorsville Police Sgt. Tracy Wyant.</p>
<p>The bullet went through a wall and struck the 28-year- old man while he was in the bathroom.</p>
<p>&#8220;After the gun was fired, both the roommate and Paul heard a scream,&#8221; Wyant said.</p>
<p>The victim was taken to a local hospital in serious condition. He was later upgraded to stable condition. Alcohol was involved in the incident, Wyant said.</p>
<p>During an ensuing search of the house, officers found a 13-year-old girl hiding in a basement closet, Wyant said. The girl told police she had sneaked out of her house without her father&#8217;s knowledge to see Kunzler, according to a jail report.</p>
<p>After further questioning, investigators learned Kunzler and the 13-year-old had been having a relationship for four months. The two had met through a common friend, Wyant said.</p>
<p>It was not known Wednesday whether any of Kunzler&#8217;s three housemates were aware of the relationship.</p></blockquote>
<p>Doesn&#8217;t this story sounds almost like a CrimLaw hypo?</p>
<p>&#8220;Larry, Curly and Moe share an apartment. The apartment has a mouse. Larry decides to try out a new mousetrap to kill the mouse: his .22 Ruger. He shoots at the mouse and in the process hits Curly, who screams in pain. Curly is taken to the hospital while police investigate. The police go into the basement and discover Moe fondling a 13-year-old girl. Discuss all relevant issues.&#8221;</p>

<p>DURHAM — Raymond Pierce, who has lead the N.C. Central University School of Law to increased funding and national prominence, is leaving his post as dean to take a position with a Raleigh law firm.</p>
<p>Pierce, who has been dean at NCCU since 2005, will join Nelson Mullins Riley &amp; Scarborough as a partner at the end of the academic year.</p>
<p>&#8220;It has been a great honor and pleasure to have worked with so many outstanding people at NCCU,&#8221; said Pierce. &#8220;Although I will greatly miss being at the university, I look forward to being at Nelson Mullins and returning to the practice of law.&#8221;</p>
<p>Before becoming dean, Pierce was a partner at the firm of Baker Hostetler where he represented clients in the steel, energy, banking and private equity business.</p>

<p>During Pierce’s tenure, the law school has seen increased applications, enrollment and alumni giving. The school twice has been rated No. 1 for best value Law School and has been included in a top 10 list of most popular law schools.</p>

<p>In 2008, Pierce led a successful effort to equalize state funding between the law school at UNC Chapel Hill and NCCU, the state’s only two public law schools. Pierce also has elevated the prominence of the law school by securing visits from dignitaries such as U.S. Attorney General Eric Holder and U.S. Supreme Court Chief Justice John Roberts.</p></blockquote>

<p>Many of us have known this was coming since at least August when the Chief all-but-announced the news at the first SBA Presidents&#8217; Roundtable meeting. Even so, it makes me incredibly nervous for the next few years at NCCU Law.</p>
<p>Any time you&#8217;ve got a transition of leadership at a public institution it creates a window for slashing budgets and making other changes that established leaders had previously blocked. See, e.g., what&#8217;s happened to the consolidated University of North Carolina the instant former University President Erskine Bowles stepped down, with billions (with a &#8216;B&#8217;) slashed from the University budget and multiple 4-figure tuition increases at constituent institutions across the state slated to take effect next academic year.</p>
<p>It&#8217;s also commonplace for educational institutions to alternate between more &#8220;business&#8221;-oriented leaders and more &#8220;academic&#8221;-oriented leaders. The UNC system is a good example with academic Bill Friday followed by businessman Dick Spangler followed by academic Molly Broad followed by businessman Erskine Bowles followed now by former Davidson College President Tom Ross.</p>
<p>If NCCU Law follows that pattern, we&#8217;re likely to get someone academically oriented as our next Dean&#8230; and I&#8217;m uncertain (at this point at least) if that&#8217;ll be a wise decision in a period of budget austerity. Students want someone friendly toward them who will focus on polishing the academic credentials of the school, but money is what helps make all that happen. We need someone who can twist arms at the General Assembly, convince alumni to open their wallets, and make sure tuition stays low so NCCU Law can continue honoring its historical mission to reach out to underserved communities and dominating the cost-conscious sector of legal education in North Carolina.</p>
<p>But that&#8217;s just my $.02, and I could be wrong.<sup><a href="http://www.lawdevnull.com/2011/12/the-chief-announces-his-retirement/#footnote_0_6349" id="identifier_0_6349" class="footnote-link footnote-identifier-link" title="On a completely and totally unrelated side note, this continues the weird pattern of my time in Student Government coinciding with people leaving their jobs  &nbsp;NC State&amp;#8216;s Chancellor Jim Oblinger stepped down at the end of my time as Student Senate President, UNC-system President Erskine Bowles stepped down at the end of my tenure as UNCASG President, and now the Dean will be stepping down at the end of my tenure as SBA President. <p>Now I&#8217;m no fan of the Occupy movement and Occupiers&#8217; tendency to willfully violate the private property rights of others to try and make a point.<sup><a href="http://www.lawdevnull.com/2011/11/are-all-california-police-just-nuts/#footnote_0_6209" id="identifier_0_6209" class="footnote-link footnote-identifier-link" title="I&amp;#8217;ll concede I wholeheartedly agree with the Occupy folks with respect to crony capitalism bearing some responsibility for the economic mess we&amp;#8217;re in &amp;#8212; but they don&amp;#8217;t seem to grasp that the reason crony capitalism persists is because it&amp;#8217;s incredibly lucrative when the federal government has its tentacles in every cookie jar available. A regulation costing you or I a nickel apiece might cost a given industry millions of dollars, which prompts companies to buy legions of lobbyists to push for special favors from the government. That&amp;#8217;s why things turn into a mess. End crony capitalism, but also end the government overreach that promotes crony capitalism.">1</a></sup> Even so, this is downright insane <img src='http://www.lawdevnull.com/wp-includes/images/smilies/crack.gif' alt=':crack:' class='wp-smiley' /> </p>
<p>The university&#8217;s claim that the pepper spraying was prompted by a &#8220;hostile&#8221; situation is thoroughly debunked by the video. There&#8217;s nothing here but a bunch of wannabe hippies sitting there linking arms thinking it&#8217;ll make a difference in tuition increases.<sup><a href="http://www.lawdevnull.com/2011/11/are-all-california-police-just-nuts/#footnote_1_6209" id="identifier_1_6209" class="footnote-link footnote-identifier-link" title="Though I suspect most of them aren&amp;#8217;t registered to vote, and I doubt they&amp;#8217;ve tried any of the tactics we successfully deployed in UNCASG.">2</a></sup></p>
<p>They weren&#8217;t preventing the ingress or egress of vehicular traffic, presenting a safety hazard, or causing any other public disturbance to a level that demanded the use of force. Totally, shamelessly, incontrovertibly outrageous &#8212; what seems to be <a title="law:/dev/null: Maybe I could do a career in radio?" href="http://www.lawdevnull.com/2011/11/maybe-i-could-do-a-career-in-radio/">a recurring theme among California law enforcement</a> agencies.</p>
<p>Remind me not to visit California again any time soon&#8230;</p>

			<content:encoded><![CDATA[<p>Waaayyyyy back during the halcyon days following 1L year, I wrote <a title="law:/dev/null: In support of the strict C" href="http://www.lawdevnull.com/2010/06/in-support-of-the-strict-c/">this entry explaining why I supported the &#8220;strict C&#8221; curve</a> we use at the <a title="N.C. Central University School of Law" href="http://law.nccu.edu/">North Carolina Central University School of Law</a>. &#8220;Setting the middle grade in the middle of the grading scale,&#8221; I wrote back then, &#8220;provides law professors with a full range of options to give you &#8212; and gives you the student a full range of feedback so you know where you&#8217;re weak and need to improve.&#8221;</p>
<p>In the subsequent comments I expanded on that theme a smidge more, but basically my philosophy on the curve was/is this: we&#8217;re attending law school to become proficient in the law (not simply to become employed as lawyers), grades are the best opportunity for professors to give feedback to students on where they&#8217;re strong or weak, and anything short of what we use at NCCU Law encourages &#8220;innovation&#8221;/inflation in grading to the point where that feedback becomes functionally useless.</p>
<p>Nothing I&#8217;ve seen or experienced in the 17 months since writing that post has prompted me to change my mind or otherwise reconsider my position.</p>
<p>Well now the faculty are contemplating some tweaks to the curve &#8212; whether or not to explicitly codify it in a new publicly-distributed document and, if so, whether to inflate where it&#8217;s centered &#8212; and I&#8217;m in a bit of a pickle as SBA President as a result. Literally 100% of the classmates I&#8217;ve spoken to about the issue over the past 2 years have expressed unconditional hostility toward our grading system&#8230;</p>
<p>&#8230;and I still think they&#8217;re all wrong <img src='http://www.lawdevnull.com/wp-includes/images/smilies/beatup.gif' alt=':beatup:' class='wp-smiley' /> </p>
<p>The main argument given to me is that inflating the curve will make our people more competitive in the job market, especially with bigger employers who don&#8217;t bother to read the paragraph of text atop our transcripts explaining we use a C curve.</p>
<p>It&#8217;s an understandable theory, but (to the extent people pay attention to rankings or &#8220;brand name&#8221;) we&#8217;re still a regional Tier IV law school that simply cannot expand much beyond where we are without spending a ridiculous amount of money. Consider: <a title="Campbell Law" href="http://law.campbell.edu/">Campbell Law</a>&#8216;s tuition and fees ($33,910.00) are downright obscene compared to what NCCU Law charges ($5,207.49) and they&#8217;ve only just now broken from Tier IV to the very bottom of Tier III &#8212; still only regional in reach, with graduates still facing the same challenges as us Legal Eagles if they try to venture beyond the borders of North Carolina.</p>
<p>Then there&#8217;s my personal suspicion that NCCU Law just plain doesn&#8217;t tell it&#8217;s story very well. Judging by the search queries and the emails I get, apparently <em><strong>law:/dev/null</strong></em> is one of the main sources of information for prospective students looking to attend the institution. Now as much as I love (love <strong>love</strong> <em><strong>love</strong></em>) the attention and visitors, it&#8217;s downright crazy that a one-man blawg can have any marketing reach at all relative to an established law school with decades of alumni. If you&#8217;re concerned about employability of the portion of our graduates going to other states, let&#8217;s get our branding and outreach up to par before we start tinkering with the grading system.</p>
<p>While the potential benefits to re-centering the curve are hypothetical at best, I&#8217;d argue the things we lose as a result are far more concrete.</p>
<p>The family atmosphere at the law school (see #4 on <a title="law:/dev/null: Why NCCU?" href="http://www.lawdevnull.com/why-nccu-law/">why NCCU Law was my first choice</a>) is rooted on the shared experience of trying to overcome such a gruesome curve; being <a title="law:/dev/null: Spring '10 Final Grades (or, &quot;A 2L. For srs.&quot;)" href="http://www.lawdevnull.com/2010/06/spring-10-final-grades/">one of the survivors of 1L year</a> is A Big Deal™. And our graduates are practice-ready on Day 1 because we don&#8217;t sugarcoat incompetence &#8212; if you do something poorly, the curve let&#8217;s you know you do something poorly. I can&#8217;t help but feel a little nauseous every time I hear Jack Boger (Dean at <a title="UNCCH Law" href="http://www.law.unc.edu/">UNCCH Law</a>) talk about all the &#8220;innovative&#8221; things they&#8217;re doing to make UNCCH Law grads practice-ready &#8212; stuff NCCU Law has been doing literally <span style="text-decoration: underline;"><em>for years</em></span> through our clinical programs, rigorous grading, and willingness to kick out people who come up short.</p>
<p>Is it worth sacrificing our identity as a no-bullsh*t law school just for a boost to some folks&#8217; GPAs? Sacrificing graduates who are practice-ready on Day 1? Sacrificing the &#8220;we&#8217;re in this together&#8221; mentality?</p>
<p>Personally I vote no.</p>
<p>I know I&#8217;ve got a roughly 0% chance of convincing my colleagues to concur though, so I&#8217;ll just have to grab a bag of popcorn and see what happens next <img src='http://www.lawdevnull.com/wp-includes/images/smilies/beatup.gif' alt=':beatup:' class='wp-smiley' /> </p>

<p>I&#8217;m also noting up-front that I&#8217;m generally not the type to ascribe supernatural causes to naturally occurring phenomena.</p>
<p>But yesterday I was busy having a mini-meltdown over finances after a follow-up dental appointment for <a title="law:/dev/null: Most expensive. semester. evah." href="http://www.lawdevnull.com/2011/08/most-expensive-semester-evah/">the crown issue I mentioned in passing last week</a>, trying to figure out how to pay for the bar app, bar review, etc etc etc and knowing my financial aid refund was still days away.</p>
<p>The weather was forecast to be clear. And rather than go back to school, I randomly decided to go home instead&#8230; where it was practically a monsoon <img src='http://www.lawdevnull.com/wp-includes/images/smilies/beatup.gif' alt=':beatup:' class='wp-smiley' /> </p>
<p>I tried to take a photo what greeted me when I got to the apartment.<sup><a href="http://www.lawdevnull.com/2011/08/icanhazgoldnow/#footnote_0_5846" id="identifier_0_5846" class="footnote-link footnote-identifier-link" title="The actual rainbow was a lot brighter but the camera barely picked it up.">1</a></sup></p>
<p>Never been that close to a rainbow in my life (except the ones I created myself while hand-washing a car). Didn&#8217;t see a pot of gold anywhere, but I&#8217;m taking it as a sign not to stress <img src='http://www.lawdevnull.com/wp-includes/images/smilies/wink.gif' alt=';)' class='wp-smiley' /> </p>

<p>I need your help plz <img src='http://www.lawdevnull.com/wp-includes/images/smilies/angel.gif' alt=':angel:' class='wp-smiley' /> </p>
<p>Each year, the ABA Journal compiles <a title="ABA Journal Blawg 100" href="http://www.abajournal.com/blawg100">its annual Blawg 100</a> &#8212; a pretty cool categorized listing of the top 100 legal blogs on the web. As part of that process they developed <a title="ABA Journal: Blawg 100 Amici" href="http://www.abajournal.com/blawgs/blawg100_submit/">a &#8220;Blawg 100 Amici&#8221; form</a> where folks can submit recommendations of blawgs the ABA Journal folks should check out.</p>
<p>I filled out one form last year (nominating <a title="Dennis Jansen" href="http://www.dennis-jansen.com/">Dennis Jansen</a>) and plan to submit more this year&#8230;</p>
<p>&#8230;but with my chronic disappearances over the past semester I don&#8217;t really know as much as I should about the law student portion of the blawgosphere anymore <img src='http://www.lawdevnull.com/wp-includes/images/smilies/beatup.gif' alt=':beatup:' class='wp-smiley' /> </p>
<p>So I&#8217;m turning to you for info: which law student blawgs should I be looking at that I&#8217;m not? is there anyone new out there who isn&#8217;t included in the <strong><em>law:/dev/null</em></strong> blogroll? and which folks merit me (and others) turning in amici forms?</p>

			<content:encoded><![CDATA[<p>I meant to post this for y&#8217;all when it came out a couple weeks ago, but the good folks over at the <a title="The Chronicle of Higher Education" href="http://chronicle.com/">Chronicle of Higher Education</a> put together a pretty awesome and thorough series of <a title="Chronicle.com: How Educated are State Legislators?" href="http://chronicle.com/article/How-Educated-Is-Your/127845/">articles on</a> <a title="Chronicle.com: For Love of Alma Mater: Does a Degree Influence Decision Making?" href="http://chronicle.com/article/For-Love-of-Alma-Mater-Does-a/127837/">the education level</a> <a title="Chronicle.com:  Legislators Talk About Their Degrees -- or Lack of Them" href="http://chronicle.com/article/Lawmakers-Talk-About-Their/127846/">attained by</a> <a title="Chronicle.com: Diplomas for Legislators: Nice, but not Necessary" href="http://chronicle.com/article/Diplomas-for-Legislators-/127852/">state legislators</a> in all 50 states.</p>
<p>Now I&#8217;m not one of those folks who thinks having a college degree should be a prerequisite for public service; although I&#8217;m a big supporter of higher education, I also know some of the wisest people I know (like my grandparents) never got one.</p>
<p>Besides, I&#8217;d hate to imagine the thought of being permanently precluded from public service if I had never made it back into N.C. State <img src='http://www.lawdevnull.com/wp-includes/images/smilies/beatup.gif' alt=':beatup:' class='wp-smiley' /> </p>

<p>But, that point notwithstanding, it <em><strong>was</strong></em> intriguing to see <a title="Chronicle.com: Degrees in the Statehouse" href="http://chronicle.com/article/Degrees-in-the-Statehouse-/127797/">this fancy interactive map</a> with the end results graphed out &#8212; especially after clicking the &#8220;Law School&#8221; tab, where it turns out only ~17% of legislators nationwide went to law school. <img src='http://www.lawdevnull.com/wp-includes/images/smilies/icon_eek.gif' alt=':surprised:' class='wp-smiley' /> </p>
<p>Maybe my perception had just been skewed by what I read in the press or learned in my social studies classes in K-12, but I was always under the impression lawyers were the dominant profession in politics.  It made intuitive sense considering how <a title="law:/dev/null: Plain English FTL" href="http://www.lawdevnull.com/2010/03/plain-english-ftl/">needlessly complicated some of the most basic statutes can be</a> in a given state.</p>
<p>Yet according to the &#8220;real world&#8221; data, even in the most attorney-packed legislature in the country (Texas), there are still more than 2x as many non-lawyers as there are lawyers. <img src='http://www.lawdevnull.com/wp-includes/images/smilies/crack.gif' alt=':crack:' class='wp-smiley' /> </p>

<p>With the first summer session here at <a title="N.C. Central University School of Law" href="http://law.nccu.edu/">NCCU Law</a> getting underway tomorrow, today got spent tying up loose ends before the back-to-school grind resumes. And in the process I re-discovered some of the effects of final exam season: over the last 3 weeks of my 2L Spring semester, we lost about half of our regular readers as <em><strong>law:/dev/null</strong></em> has gone un-updated&#8230; and I managed to pack on another 10lbs around my waistline.<sup><a href="http://www.lawdevnull.com/2011/05/how-to-successfully-lose-half-your-readers-and-gain-10-pounds/#footnote_0_5319" id="identifier_0_5319" class="footnote-link footnote-identifier-link" title="A repeat of the end of my 2L Fall semester, but this time without Thanksgiving as an excuse  ">1</a></sup> <img src='http://www.lawdevnull.com/wp-includes/images/smilies/beatup.gif' alt=':beatup:' class='wp-smiley' /> </p>
<p>So while all the cool kids make New Year&#8217;s Resolutions about getting in shape and other worthwhile endeavors, in honor of my procrastinating tendencies I&#8217;m making those resolutions 5 months late instead: effective today I&#8217;m improving my diet, exercising more, and finally posting an update to the blog <img src='http://www.lawdevnull.com/wp-includes/images/smilies/wink.gif' alt=';)' class='wp-smiley' /> </p>

<p>Here&#8217;s a quick rundown of where I&#8217;ve been the past few weeks:</p>

<li style="padding-bottom: 5px;">&#8230;then un-became a 3L, as my Scientific Evidence professor unexpectedly gave the entire class 3 days to turn in an extra assignment &#8212; and I proceeded to sequester myself in my apartment like a hermit until it was finished</li>
<li style="padding-bottom: 5px;">Re-became a 3L again, for real this time <img src='http://www.lawdevnull.com/wp-includes/images/smilies/spin.gif' alt=':spin:' class='wp-smiley' /> </li>
<li style="padding-bottom: 5px;">Took over as President of our <a title="NCCU Law Student Bar Association" href="http://www.nccusba.org/">Student Bar Association</a></li>
<li style="padding-bottom: 5px;">Amped up my work schedule at <a title="Integrated Industrial Information, Inc." href="http://www.i-cubed.com/">I-Cubed</a> to 40hrs a week&#8230; right before realizing I probably can&#8217;t continue at that pace when summer school starts ::headdesk::</li>
<li style="padding-bottom: 5px;">Watched the Class of 2011 graduate</li>
<li style="padding-bottom: 5px;">Watched the law school <a title="Google Search: nccu law speech" href="http://www.google.com/search?q=nccu%20law%20speech">end up in a minor scandal</a> after graduation <img src='http://www.lawdevnull.com/wp-includes/images/smilies/beatup.gif' alt=':beatup:' class='wp-smiley' /> </li>
<li style="padding-bottom: 5px;">Tallied up the private $$$ the SBA raised last year &#8212; an all-time record in law school history &#8212; and how much the 2011-12 SBA has raised in the past few weeks<sup><a href="http://www.lawdevnull.com/2011/05/how-to-successfully-lose-half-your-readers-and-gain-10-pounds/#footnote_1_5319" id="identifier_1_5319" class="footnote-link footnote-identifier-link" title="A +32% year-over-year increase, positioning us to beat last year&amp;#8217;s record  ">2</a></sup></li>
<li style="padding-bottom: 5px;">Penned my 2nd guest column for the <a title="Beyond Hearsay" href="http://www.beyondhearsay.com/">Beyond Hearsay</a> blog (publication date TBD)</li>
<li style="padding-bottom: 5px;">Spent $350 on books for summer school <img src='http://www.lawdevnull.com/wp-includes/images/smilies/icon_eek.gif' alt=':surprised:' class='wp-smiley' /> </li>
<li style="padding-bottom: 5px;">Spent hours reading ~150 pages for tomorrow&#8217;s first day of class</li>
<li style="padding-bottom: 5px;">Finally got around to updating <em><strong>law:/dev/null</strong></em>, including tweaking <a title="law:/dev/null: About" href="http://www.lawdevnull.com/about-t-greg-doucette/">our About page</a> to reflect my now-3L status <img src='http://www.lawdevnull.com/wp-includes/images/smilies/biggrin.gif' alt=':D' class='wp-smiley' /> </li>
</ul>
<p>That&#8217;s the rundown. Nothing particularly exciting&#8230; which makes me wonder how exactly time has flown by so fast <img src='http://www.lawdevnull.com/wp-includes/images/smilies/crack.gif' alt=':crack:' class='wp-smiley' /> </p>
<p>I&#8217;d be lying to you if I said I expected to resume regular blog updates, simply because my summer school schedule <a title="law:/dev/null: Quick look at Summer 2011 classes" href="http://www.lawdevnull.com/2011/03/quick-look-at-summer-2011-classes/">leans toward the crazy side this year</a> (10 credit hours total) when it&#8217;s coupled with my internship. <span style="text-decoration: underline;"><strong><em>But</em></strong></span> my hope is I&#8217;ll work my way into a routine and can get back to posting somewhat regular content.</p>
